Personal Injury

Personal injury is a term used to describe any case in which individuals have suffered physical injuries due to the wrongful conduct of others. Personal injury cases arise from motor vehicle accidents, construction accidents, medical mishaps, police misconduct, and a myriad of other situations. Fault may consist of intentional wrongdoing, wanton and willful misconduct or negligence.

In the typical case, the injured party, known as the plaintiff, must prove that the defendant was at fault and that the fault was a proximate cause of plaintiff’s injury. For example, in an automobile accident case, we have to prove that the defendant did something negligent such as running a red light or speeding, that there was a collision, and that the plaintiff’s injuries were caused by the collision. Typically, the defendant and his insurance company will claim that the defendant was not at fault, that the plaintiff was at fault, that plaintiff’s injuries were not so bad, and that, in any event, plaintiff’s injuries weren’t caused by the accident.

In medical negligence (medical malpractice) cases, the plaintiff’s burden of proof is more difficult because we have to establish through expert testimony that the defendant doctor or nurse departed from accepted medical standards. Causation is often more difficult, too, because the plaintiff usually was sick or injured to begin with. Understanding the medicine and recruiting top quality expert witnesses is a key to success in the medical malpractice field.

Personal injury also includes injuries caused by defective products. Product liability cases focus on the unreasonably dangerous condition of the product rather than the fault of the defendant. A case can involve negligence and product liability such as where a car accident is caused by a driver’s negligence and then the air bags fail to deploy because of a product defect.
Damages in personal injury cases consist of compensation for medical expenses, wage loss, disability, disfigurement, and pain and suffering. Where personal injury results in death, the decedent’s claim survives the death. In addition, immediate family members can bring their own claim for wrongful death. Their damages include loss of financial support and compensation for the loss of the relationship that each family member had with their loved one.

Construction Liability

Injury to either workers or visitors while on construction sites occurs throughout the United States, and often they are due to the unsafe nature of the worksites. Power tools, partially built structures, scaffolding, ladders, lifts, heavy machinery and rotating crews of tradesmen account for some of the hazards on construction sites. Occupational Health and Safety Administration (OSHA) is the federal agency that regulates safety measures on construction sites.
If the injured party’s employer is the cause of the injury and unsafe condition, the victim can turn to worker’s compensation while recuperating from the injury. Many incidents, though, are complicated and involve numerous parties who were involved in the negligence on the jobsite. Such cases require separate construction liability suits to compensate the victim and his or her family for injury or death for the negligence. Several tort theories of liability, including negligence and strict liability, may be pursued by lawyers representing those who bring a lawsuit against all possible defendants responsible for the tragic incident. Considering the circumstances, general contractors, subcontractors, site owners and manufacturers of the tool or machine being used may be held liable for the injuries.

The complexity of construction liability cases often requires an experienced attorney pursuing a construction liability lawsuit on their behalf.

Clifford Law Offices has represented many accident victims involving various types of construction work including scaffolding accidents. For example, the scaffold accident law firm received a $75 million settlement for the injured victims and the families of those who were killed and injured when a scaffold fell from Chicago's John Hancock Center. On the eve of trial, the defendants settled in a global settlement after nearly four years of preparation for trial. A large section of the scaffold crashed on the car of four women, killing two friends in the front seat and severely injuring their mothers in the back seat. The mothers spent more than 30 minutes while the Chicago Fire Department extricated them from the tragic accident. Several defendants shared the blame for this tragic scaffold accident including the owners and managers of the building, the architects of the window improvement project for the building and the engineers of the project.
Robert Clifford also received a $1.1 million settlement on behalf of a 47-year-old ironworker who was injured and unable to continue his trade when the scissors lift he was driving fell into an excavation hole covered by snow at a warehouse construction site. Clifford and partner Richard

The attorneys’ experience at the firm combined adds up to hundreds of years of personal injury and wrongful death work. A Clifford Law Offices’ truck accident attorney examines the cause of the crash. The law firm also will examine truck accident victims’ losses that include medical expenses, lost wages, future earnings, future medical care, pain and suffering, grief, sorrow and mental suffering, loss of quality of life and other possible damage claims.
